DATA PROTECTION


Support Legal holds all necessary licences, registrations and authorisations required in order to process personal data in the United Arab Emirates, as determined in accordance with applicable law.

Where, as part of any matter for you, we process personal data about any third party (including your employees, your customers and any other third parties involved in your matter), you agree that you shall be responsible for ensuring that each data subject to whom such personal data relates:
 

  • receives a processing notice, where required in order for us to act for you on the relevant matter; and
     

  • has provided their consent to our processing of their personal data, where such consent is necessary in order for us to lawfully process their personal data as part of acting for you.

 

INFORMATION SHARING AND USE OF YOUR INFORMATION
 

You consent to the sharing of any information we obtain while acting on your behalf - including confidential and personal data - within the Support Legal group and with our service providers, as necessary to deliver the requested services and comply with legal obligations. This may involve global transfers or access to such information.


Entities and individuals within the Support Legal group may use or disclose this information to third parties for general business purposes, including but not limited to the following:

  • for conflict checking;

  • for the provision of our services to you;

  • for disclosure to other third party advisers working for you on the same matter;

  • for disclosure to third parties to whom we outsource relevant support services and where such disclosure may involve transfer, processing and storage of the information using third party software and hosting on third party platforms;

  • for fraud prevention, anti-money laundering purposes, anti-bribery purposes and/or generally for the prevention or detection of crime;

  • to comply with mandatory reporting obligations;

  • to ensure the safety and security of our people and premises (where we also use CCTV);

  • for disclosures to our auditors, our own legal and other professional advisors, our banks and insurers and insurance brokers;

  • to administer your account with us, including providing e-billing services at your request and tracing and collecting any debts;

  • conducting specific tests on or developments to our existing or new systems, networks, applications and software and for the general improvement of our services;

  • provided that you do not object to us so doing, for advertising, marketing and public relations, including sending you direct marketing communications;

  • to manage our business performance, to assess client satisfaction (such as by asking you to participate in surveys) and generally to help improve our services;

  • as otherwise required by applicable law; and

  • where you have given written consent to such use or disclosure.

 

MARKETING, SEMINARS AND TRAINING MATERIALS


We may use the contact details you provide - such as names, phone numbers, addresses, and email addresses - to send you marketing communications, including event invitations (e.g. seminars or conferences), briefings, and similar publications we believe may be of interest.

ANTI-MONEY LAUNDERING

To comply with applicable laws, Support Legal is required to conduct thorough client due diligence (CDD) and ongoing monitoring for all clients—both new and existing.
 

Before accepting instructions, we must verify the identity of:

  • all prospective clients; and

  • all related parties, including beneficial owners.


These checks must also be periodically re-verified throughout the course of our relationship.
 

Failure to provide satisfactory evidence of identity, or any suspicion that a client or associated party is engaged in unlawful activity, may result in the termination of our services. In some cases, we may be required to cease acting on a matter at the direction of the relevant authorities.


By providing CDD information to Support Legal, the client confirms that they have obtained the necessary consent from any individuals whose personal data is shared. This data may be retained beyond the end of our relationship, in accordance with our regulatory obligations and applicable limitation periods for legal claims. The retention period may change over time and could exceed six years.

 

COMMUNICATION AND INFORMATION SECURITY
 

We will communicate with you - and, where appropriate, with third parties - using standard methods such as letters, fax, email, text messages, instant messaging, telephone, voicemail, video conferencing, or via physical media such as CD-ROMs, DVDs, or USB devices. If there are any communication methods you prefer us not to use, please inform the lawyer responsible for your matter in writing.


Should you consider any communications to or from us to be particularly confidential, require specific security measures, or have alternative communication preferences, please notify the responsible lawyer in writing.


Please note that our anti-virus, anti-spam, and other security systems may occasionally block or filter legitimate emails. If you send an important email that has not been acknowledged, we recommend following up with a phone call.
 

Support Legal cannot guarantee the availability or security of its electronic information, storage, or communication systems.

 

THE SERVICES WE PROVIDE


Our services are provided exclusively for the benefit of our client. Unless expressly agreed otherwise, no other person may use or rely on the services we provide, nor derive any rights or benefits from them.


We are not responsible for notifying you of any changes in the law that occur after the date our services are delivered, or for advising on the implications of such changes, unless we have expressly agreed to do so.


Responsibility for the provision of our services rests solely with us. No individual associated with Support Legal (SL Individual) assumes personal responsibility to you, and no SL Individual owes you a personal duty of care. By instructing us, you agree that:

  1. you will not bring any claim—whether in contract, tort, statute, or otherwise—against any SL Individual or any other member of Support Legal; and

  2. SL Individuals and other members of Support Legal may rely on this provision, except where such limitation is prohibited by applicable law.
     

APPLYING AGREED LIABILITY LIMITS
 

Any liability cap agreed with you in writing shall apply as follows:

  1. to each individual matter on which we act for you;

  2. to all Losses arising in any circumstances whatsoever—whether in contract, tort, under statute, or otherwise—and however caused (including by our negligence or failure to perform); and

  3. as an aggregate cap on the liability of the Support Legal group.


Where a monetary cap on our liability has been agreed, the applicable limit shall be the greater of:

  1. the amount agreed with you in writing; or

  2. the minimum amount required by applicable law.

 

PROFESSIONAL INDEMNITY INSURANCE


Support Legal maintains professional indemnity insurance which:

  • covers our practice worldwide;

  • extends to acts and omissions of SL Individuals wherever in the world they may occur; and

  • meets the minimum insurance requirements of all professional regulations to which our practice is subject.


Our current insurers are Orient Insurance PJSC, Dubai Festival City, P.O. Box. 27966, Dubai, UAE.

CYBERCRIME WARNING – EMAIL AND BANK ACCOUNT FRAUD
 

Please be aware of the significant risk posed by cybercrime, particularly involving the interception and misuse of email communications and bank account details.
 

Important: Support Legal will never notify you of changes to its bank account details via email. If you receive an email claiming to be from Support Legal that advises of a change in bank account details - especially during the course of a transaction - please:

  • Do not reply to the email;

  • Do not act on any information it contains; and

  • Immediately contact the person handling your matter by telephone.
     

If you are ever in doubt, please do not transfer any funds to Support Legal without first speaking directly with your contact to verify the account details.


Support Legal accepts no liability for funds transferred to a bank account that is not an official Support Legal account.

FINANCIAL INSTITUTIONS AND SYSTEMS
 

If you wish to know the name of the deposit-taking institution(s) where your client money is being held, please ask the lawyer responsible for any matter.


No entity or individual within the Support Legal group shall incur any liability caused by the act, omission, fraud, delay, negligence, insolvency, collapse or default of a deposit-taking institution or a financial clearing or payment system (save to the extent of any negligence on our part). This does not affect the enforceability of any express legal undertaking.
